Definitions

• Platform – Aloah, including all websites, applications, tools, and functionalities.
• User – any individual or legal entity accessing or using the Platform.
• Content – all data, text, messages, images, videos, profiles, posts, comments, and other materials uploaded or shared by Users or the Platform.
• Professionals / Organizations – licensed psychologists, psychiatrists, therapists, life/mental/ADHD coaches, speech therapists, and other verified professionals, as well as authorized organizations, institutions, and clinics.
• Subscription – monthly membership fee or other forms of paid access to the Platform.

Introduction

These Terms of Service govern your use of the Aloah Platform. By using the Platform, you confirm that you have read, understood, and accept these Terms. If you do not agree, you must not use the Platform.

These Terms of Service (also referred to herein as these “Terms”) are an agreement between Vanilla Media (dba “Aloah”), a nonprofit organization based in Zagreb, Croatia, which is the owner and operator of  https://aloah.org (“ALOAH” “we,” “our,” “us”, “Service”, or “Platform”) and you (“you” or “You”), a user of the Service. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS, AND TO ALOAH'S PRIVACY POLICY, WHICH CAN BE FOUND AT Privacy, AND WHICH IS INCORPORATED HEREIN BY REFERENCE. PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY AGREEING TO THESE TERMS OF SERVICE, YOU ALSO CONSENT TO OUR COLLECTION, USE AND DISCLOSURE OF INFORMATION YOU PROVIDE US IN ACCORDANCE WITH OUR PRIVACY POLICY. IF YOU CHOOSE TO NOT AGREE TO ANY OF THESE TERMS, YOU MAY NOT USE THE SERVICE.

Our mission at ALOAH  is to provide a social network where the user is the center of the network, not an advertiser or some entity looking to follow and track you. ALOAH is a safe and inclusive social network where you can connect with others, share experiences, and participate in communities focused on mental health, neurodivergence, and wellbeing, without worrying about us tracking your behaviour for advertisers or selling your content.

This Terms of Use Agreement (“Agreement”) includes the terms by which you may access and use that social network and the online and/or mobile services, website, and/or software provided on or in connection with that social network (collectively, the “Service”).

Legal Terms of Use

PLEASE READ THE FOLLOWING TERMS OF USE AGREEMENT CAREFULLY. This AGREEMENT applies to all visitors, users, and others who access the Service (“Users”). THIS IS A CONTRACT BETWEEN YOU AND ALOAH. By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this AGREEMENT. If you are not eligible to use the Service or do not agree to the terms, you do not have our permission to use the Service.

Acceptance of Terms

By registering and/or using the Platform:

• you confirm that you are at least 18 years old,
• you accept these Terms and the Privacy Policy,

• you agree to comply with all applicable laws and regulations.

Age Restrictions and Eligibility

• The Platform is intended solely for individuals aged 18 and above.
• Registration of minors is strictly prohibited.
• Users providing false age information or using another person’s data are solely responsible for such actions.

Registration and User Accounts

• Users may use pseudonyms or fictitious names to protect their anonymity.
• It is prohibited to use names of public figures, brands, companies, or institutions unless the person or organization themselves registers the account.
• Public figures and organizations must undergo identity verification and confirm their license, certificate, or authorization.
• Users are responsible for the security of their login credentials and all activities under their account.

Code of Conduct

Users agree not to:

• post illegal, offensive, threatening, harassing, defamatory, or discriminatory content,
• share personal data of others without consent,
• use the Platform for fraud, spam, or unlawful activities,
• attempt to compromise the security of the Platform or others’ accounts.

User Content

• Users retain copyright to the content they post.
• By submitting content to the Platform, users grant a non-exclusive license to use such content solely for the functioning of the Platform.
• Users are fully responsible for the content they share.

Content and Services of Professionals and Organizations

• The Platform is designed and intended to enable registered professionals and organizations to provide advice, consultations, therapy, and other professional services to Users.
• All professionals and organizations must complete identity verification and confirm their degrees, licenses, and certificates; for organizations, authorized responsible individuals must also be verified.
• All content and services provided by professionals or organizations are solely their responsibility. The Platform disclaims, to the fullest extent permitted by law, any liability for accuracy, applicability, or outcomes of such services.

Intellectual Property

• All rights to design, software, logos, and materials on the Platform belong to the Platform or its partners.
• Copying, modifying, distributing, or publicly reproducing any part of the Platform without explicit permission is prohibited.

Subscriptions, Membership, Fees, and Payments

• Access to the Platform is subject to a monthly subscription fee (membership fee) at registration.
• Payments are processed through secure third-party providers.
• Refunds are granted only in accordance with applicable consumer protection laws.

Limitation of Liability and Disclaimer

• The Platform does not provide its own medical or psychological services.
• All professional services provided by verified individuals or organizations are their exclusive responsibility. The Platform disclaims all liability regarding the accuracy, applicability, or outcomes of such services.
• The Platform does not guarantee uninterrupted availability or functionality.
• To the maximum extent permitted by law, the Platform is not liable for any damages arising from the use or inability to use the Platform.

Account Termination and Suspension

• The Platform may suspend or terminate accounts violating these Terms or compromising Platform security.
• Content infringing third-party rights may be removed.

Changes to Terms

• The Platform may modify these Terms. Users will be notified via email or Platform notification. Continued use after changes constitutes acceptance.

Governing Law and Dispute Resolution

• These Terms are governed by the laws of Croatia and EU law.
• Parties will attempt to resolve disputes amicably; if not possible, the competent court is Croatia, Zagreb.
